These terms govern your use of funisland.mt ("the Platform"), operated by Fun Island. By using the Platform or making a booking, you agree to these terms.
1. About the Service
Fun Island is a marketplace that connects visitors with independent boat charter operators in Malta. We do not own, operate, or crew any vessels. Each charter is provided by an independent operator ("the Operator") who is solely responsible for the vessel, crew, and the trip itself.
2. Bookings
When you make a booking through Fun Island, you enter into a contract with the Operator for the charter service. Fun Island facilitates the booking and payment but is not a party to the charter contract between you and the Operator.
All bookings are subject to availability. We reserve the right to cancel a booking if the Operator becomes unavailable, in which case you will receive a full refund.
3. Pricing and Payment
All prices are displayed in Euros (EUR) and include the boat, skipper, and fuel unless stated otherwise. Additional extras (food, drinks, equipment) may be available at extra cost as described in each listing.
A deposit is collected at the time of booking to secure your reservation. The remaining balance is paid directly to the Operator on the day of the trip. Fun Island handles the deposit only; all other payments are between you and the Operator.
4. Cancellation Policy
- Free cancellation: up to 48 hours before the scheduled departure time for a full refund.
- Within 48 hours: cancellations are non-refundable.
- No-show: no refund is issued for no-shows.
You may reschedule your booking instead of cancelling, subject to Operator availability.
5. Weather-Back Guarantee
If your trip is cancelled by the Operator due to unsafe weather conditions, you may choose to reschedule to another available date or receive a full refund. The Operator makes the final call on weather safety, typically the evening before or early morning of the trip.
6. Safety and Liability
The Operator is responsible for the safety of all passengers during the charter. All operators on Fun Island are required to hold valid maritime licenses and carry appropriate safety equipment.
Fun Island acts solely as an intermediary. We are not liable for any injury, loss, damage, or delay arising from the charter service. The Operator carries their own insurance and is responsible for all on-water safety.
Passengers are expected to follow the skipper's instructions at all times. The skipper reserves the right to refuse boarding or end a trip early if a passenger's behavior endangers the safety of others.
7. User Accounts
You may create an account to manage bookings and save preferences. You are responsible for keeping your login credentials secure. Creating an account is optional; guest checkout is available.
8. Acceptable Use
You agree not to use the Platform for any unlawful purpose or in any way that could damage or impair the Platform. You may not submit false information, create multiple accounts to abuse promotions, or interfere with other users' bookings.
9. Intellectual Property
All content on the Platform (text, images, design, logos) is owned by Fun Island or its licensors and may not be reproduced without permission. Boat photos and descriptions are provided by Operators and remain their property.
10. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance.
11. Governing Law
These terms are governed by the laws of Malta. Any disputes arising from or related to these terms or the use of the Platform shall be subject to the jurisdiction of the Maltese courts.
